{"id":81271,"date":"2023-10-18T12:48:00","date_gmt":"2023-10-18T12:48:00","guid":{"rendered":"https:\/\/resourcework2.devstudio.work\/?p=81271"},"modified":"2024-11-12T14:05:38","modified_gmt":"2024-11-12T14:05:38","slug":"thank-you-supreme-court","status":"publish","type":"post","link":"https:\/\/resourcework2.devstudio.work\/?p=81271","title":{"rendered":"Thank you, Supreme Court of Canada"},"content":{"rendered":"\n<p>Introducing the Impact Assessment Act (IAA) in 2019, the federal government promised speedier processing of natural-resource projects \u201cthrough legislated timelines.\u201d<\/p>\n\n\n\n<p>It didn&#8217;t happen.<\/p>\n\n\n\n<p>As the&nbsp;<a href=\"https:\/\/cwf.ca\/wp-content\/uploads\/2023\/04\/CWF-Federal-IAA-Under-Review-Report-MAY2023.pdf\">Canada West Foundation<\/a>&nbsp;reported earlier this year: \u201cThe IAA was intended to speed up a cumbersome application process for major infrastructure and resource projects, some of which were in the assessment process for up to ten years.<\/p>\n\n\n\n<p>\u201cHowever . . . all projects progressing under assessment by the Impact Assessment Agency of Canada are still in Phase 1 or 2 of the four-phase process.\u201d<\/p>\n\n\n\n<p>The IAA process mandates that projects should proceed through \u2018Phase 1 \u2013 Planning\u2019 in just 180 days. But the Canada West Foundation noted that \u201cit took projects an average of&nbsp;<em>332 days<\/em>&nbsp;to complete Phase 1, with a range of 127 to 693 days.\u201d<\/p>\n\n\n\n<p>In other words, Phase 1 alone takes twice as long as the act intended, much less following phases. These delays cost projects a lot of valuable time and money, which discourages companies from investing in Canada and proposing new, prosperity-creating projects.<\/p>\n\n\n\n<p>With 23 projects stuck today in Ottawa\u2019s slow-motion process, that alone provides 23 reasons to welcome the Supreme Court of Canada\u2019s dismemberment of the Impact Assessment Act, and to look for better legislation.<\/p>\n\n\n\n<p>The IAA was first deemed unconstitutional in a majority opinion from the&nbsp;<a href=\"https:\/\/canadainfo.net\/eng\/albertas-highest-court-deems-impact-assessment-act-unconstitutional\/\">Alberta Court of Appeal<\/a>&nbsp;in May. The federal government then referred it to the Supreme Court of Canada, where, in a 5-2 decision,&nbsp;<a href=\"https:\/\/decisions.scc-csc.ca\/scc-csc\/scc-csc\/en\/item\/20102\/index.do\">the court declared<\/a>&nbsp;that part of the Impact Assessment Act covering \u201cdesignated projects\u201d is beyond the powers of Parliament and is unconstitutional.<\/p>\n\n\n\n<p>Chief Justice Richard Wagner wrote: \u201cIn my view, Parliament has plainly overstepped its constitutional competence.\u201d<\/p>\n\n\n\n<p>The chief justice went on to say: \u201cEnvironmental protection remains one of today\u2019s most pressing challenges. To meet this challenge, Parliament has the power to enact a scheme of environmental assessment. Parliament also has the duty, however, to act within the enduring division of powers framework laid out in the Constitution\u201d.<\/p>\n\n\n\n<p>He noted that \u201cit is open to Parliament and the provincial legislatures to exercise their respective powers over the environment harmoniously, in the spirit of cooperative federalism.\u201d<\/p>\n\n\n\n<p>Industry leaders were quick to applaud the Supreme Court\u2019s opinion. Three leaders wrote in&nbsp;<a href=\"https:\/\/biv.com\/article\/2023\/10\/opinion-supreme-court-scrap-environment-assessment-bill-positive-step\"><em>Business in Vancouver<\/em><\/a>&nbsp;that it is a positive step toward creating a better investment climate for the major projects that support families, jobs and prosperity.<\/p>\n\n\n\n<p>It was desperately needed, said the industry leaders.<\/p>\n\n\n\n<p>\u201cWith the Organization of Economic Cooperation and Development projecting Canada&#8217;s economic growth to be dead last among 38 advanced economies over the next decade, one had to wonder: Has the nation&#8217;s commitment to red tape and complexity crushed any vision for a more prosperous future?\u201d<\/p>\n\n\n\n<p>The three went on to say: \u201cThe federal government claimed that the review process ushered in by the&nbsp;IAA&nbsp;would be more efficient and effective, but as industry stakeholders know only too well, Bill C-69\u2019s vague and subjective criteria created uncertainty that stifled investor confidence. And investors spoke with their chequebooks \u2013 since 2014, direct investment leaving Canada has exceeded investment coming to our country. . . .<\/p>\n\n\n\n<p>\u201cWhen the Trudeau Government introduced the&nbsp;IAA&nbsp;in 2019, Canada had already lost $100 billion in investment in major projects between 2017 and 2018, according to a report from the&nbsp;<a href=\"https:\/\/www.cdhowe.org\/sites\/default\/files\/attachments\/research_papers\/mixed\/Commentary%20534%20Compressed.pdf\">CD Howe Institute.<\/a>\u201d<\/p>\n\n\n\n<p>From the US to Australia, other countries are rushing to develop their responsible natural resources, especially LNG (liquefied natural gas). But in Canada, we have instead prioritized \u201ccomplexity, endless review, no limit on costs, and leaving affordability for the consumer out of the equation.\u201d<\/p>\n\n\n\n<p>The&nbsp;Canadian Association of Petroleum Producers was an intervener in the case. It voiced its agreement with the initial decision by the Alberta Court of Appeal and the subsequent Supreme Court of Canada ruling, saying that the provinces are best positioned to review and regulate resource development projects within their own borders.<\/p>\n\n\n\n<p>But it\u2019s not just the energy industry pleased to see the IAA sent back for revision. The&nbsp;<a href=\"https:\/\/mining.ca\/resources\/press-releases\/mac-statement-on-the-supreme-court-of-canadas-opinion-on-the-constitutionality-of-the-impact-assessment-act-iaa\/\">Mining Association of Canada<\/a>&nbsp;asked Ottawa to move quickly, citing some 20 mining projects currently undergoing federal assessment or about to enter the assessment process.<\/p>\n\n\n\n<p>\u201cThe transition to another legislative framework will have to be well-planned to mitigate the potential impact of uncertainty on Canada\u2019s investment climate,\u201d it said.<\/p>\n\n\n\n<p>The IAA\u2019s predecessor, the Canadian Environmental Assessment Act of 2012, was also criticized for excessively long project approval timelines. Under it, according to Canada West Foundation data, it took almost 3.5 years on average for projects to either receive approval or be terminated, with some projects taking over 10 years.<\/p>\n\n\n\n<p>In its March 2023 budget, the federal government promised $25 million to \u201cstudy the problem\u201d of the sluggish approval process under its successor, the IAA, and pledged to produce \u201ca concrete plan to improve the efficiency of the impact assessment and permitting processes for major projects\u201d by the end of this year.<\/p>\n\n\n\n<p>Now, following the release of the Supreme Court\u2019s opinion,&nbsp;<a href=\"https:\/\/www.ctvnews.ca\/politics\/guilbeault-happy-to-course-correct-after-scc-impact-assessment-ruling-but-outcome-for-projects-likely-no-different-1.6601658\">Environment Minister Steven Guilbeault<\/a>&nbsp;was quick to say, \u201cThe Act still stands.\u201d And that \u201cWe will be happy to course-correct the Act in the coming months to ensure that we have a more specific definition of public interest.\u201d<\/p>\n\n\n\n<p>Asked whether he believes any future changes to the IAA in light of the Supreme Court ruling will change the outcome of the IAA process for projects, he said \u201cno.\u201d<\/p>\n\n\n\n<p>All that sounds as if Guilbeault may still be set on ensuring Ottawa has the power to define what \u201cpublic interest\u201d is, and for the minister to continue to use \u201cdiscretionary powers\u201d to block projects he doesn&#8217;t like \u2013 despite a strong case from the Martin Ignasiak, Head of Energy Regulatory Practice at Bennett Jones LLP, that the Court\u2019s ruling requires a major overhaul of the IAA.<\/p>\n\n\n\n<p>In his article for the&nbsp;<a href=\"https:\/\/macdonaldlaurier.ca\/the-government-of-canada-needs-to-come-to-grips-with-the-supreme-courts-iaa-decision-martin-ignasiak-for-inside-policy\/\">Macdonald-Laurier Institute<\/a>, Ignasiak wrote: \u201cContrary to the ministers\u2019 statements at their press conference, amendments won\u2019t address the Court\u2019s criticisms of the IAA\u2019s designated projects regime. Instead, to properly reflect the Court\u2019s opinion, the federal government must revisit its entire approach to environmental assessment.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/resourcework2.devstudio.work\/wp-content\/uploads\/2023\/10\/IRC-1024x683.jpg\" alt=\"\" class=\"wp-image-83912\" srcset=\"https:\/\/resourcework2.devstudio.work\/wp-content\/uploads\/2023\/10\/IRC-1024x683.jpg 1024w, https:\/\/resourcework2.devstudio.work\/wp-content\/uploads\/2023\/10\/IRC-300x200.jpg 300w, https:\/\/resourcework2.devstudio.work\/wp-content\/uploads\/2023\/10\/IRC-768x512.jpg 768w, https:\/\/resourcework2.devstudio.work\/wp-content\/uploads\/2023\/10\/IRC.jpg 1200w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><figcaption class=\"wp-element-caption\"><em>Stephen Buffalo, CEO and President of the Indian Resource Council. Photo from CBC.<\/em><\/figcaption><\/figure>\n\n\n\n<p>It\u2019s time now for the Prime Minister to ensure that the new project-approval process he presents to Parliament leaves all doors carefully and clearly open for that \u201cspirit of cooperative federalism\u201d to tackle Canada\u2019s climate issues.<\/p>\n\n\n\n<p>And, while at it, Ottawa must ensure that Indigenous opinions and Indigenous knowledge form a significant and meaningful part of the new process. With two major LNG projects being pushed by Indigenous proponents, Cedar LNG and Ksi Lisims LNG, this has never been so important.<\/p>\n\n\n\n<p>The Indian Resource Council (representing 130 Nations that produce or could produce oil and gas)&nbsp;<a href=\"https:\/\/www.scc-csc.ca\/WebDocuments-DocumentsWeb\/40195\/FM040_Intervener_Indian-Resource-Council.pdf\">submitted to the Supreme Court<\/a>&nbsp;that \u201cunder the guise of \u2018protection\u2019 the IAA work[ed] to prevent First Nations from achieving economic self-determination.\u201d<\/p>\n\n\n\n<p>This argument had, in fact, been accepted in other court challenges to the Act on the ground that the federal government did not adequately consult on Indigenous economic interests.<\/p>\n\n\n\n<p>With this new ruling, the federal government has a chance to reset its relationship with both the provinces and with Indigenous communities developing the major projects that will take Indigenous economic development, and Canadian opportunity, to new heights.<\/p>\n\n\n\n<p>Let\u2019s hope cooperation, not intransigency, carries the day.<\/p>\n\n\n\n<p><em>This article was originally written by the&nbsp;<\/em><a
