{"id":81315,"date":"2023-06-23T12:22:00","date_gmt":"2023-06-23T12:22:00","guid":{"rendered":"https:\/\/resourcework2.devstudio.work\/?p=81315"},"modified":"2025-09-04T03:29:49","modified_gmt":"2025-09-04T03:29:49","slug":"first-nations-fight-fish-farm-closures","status":"publish","type":"post","link":"https:\/\/resourcework2.devstudio.work\/?p=81315","title":{"rendered":"First Nations fight BC fish farm closures"},"content":{"rendered":"\n<p>Ottawa\u2019s latest delay of its plan to ban open-net ocean salmon farming in BC has been hailed by both proponents and opponents of open-net aquaculture.<\/p>\n\n\n\n<p>The industry and some First Nations say it gives federal Fisheries Minister Joyce Murray a chance to finally get it right \u2014 by accepting her own scientists who say farms pose \u201cminimal risk\u201d to wild salmon and by accepting that a number of First Nations support salmon aquaculture.<\/p>\n\n\n\n<p>Seventeen First Nations in BC have formal agreements with salmon farming companies, yet Ottawa has already torpedoed 19 salmon farms in BC ocean waters. Now at stake are 57 remaining salmon farms and 79 federal salmon farming licenses.<\/p>\n\n\n\n<p>Opponents of salmon farming (also including some First Nations) hope Ottawa\u2019s new delay will end with the federal government banning all other open-net farms and ordering a transition to land-based aquaculture.<\/p>\n\n\n\n<p>Ottawa has long spoken of developing a plan for a&nbsp;<a href=\"https:\/\/www.canada.ca\/en\/fisheries-oceans\/news\/2022\/06\/transition-plan-for-open-net-pen-salmon-farming-in-british-columbia.html\">\u201ctransition\u201d<\/a>&nbsp;to some other form of salmon farming in BC, perhaps on land, perhaps in the ocean, by 2025.<\/p>\n\n\n\n<p>But a&nbsp;<a href=\"https:\/\/bcsalmonfarmers.ca\/news\/british-columbia-ministry-of-agriculture-and-food-report-concludes-land-based-salmon-farming-faces-many-challenges\/\">BC government report<\/a>&nbsp;says regulatory uncertainty, high capital cost, and low returns on investment are primary restraints on alternative forms of salmon farming in BC.<\/p>\n\n\n\n<p>One&nbsp;<a href=\"https:\/\/seawestnews.com\/bc-not-ready-for-large-land-based-salmon-farms\/\">BC government expert<\/a>&nbsp;says it would probably take seven to ten years to \u201cbuild something that works\u201d on land. Meanwhile, a BC pioneer of land-based aquaculture says: \u201cThere is simply not enough power available to do large-scale land-based salmon farming in BC and that is the biggest hurdle.\u201d<\/p>\n\n\n\n<p>The Department of Fisheries and Oceans Canada (DFO) announced the latest federal delay in early June: &#8220;To respond to requests from First Nations and others, we have extended consultation on the open-net pen aquaculture transition to all interested parties through the summer. The transition plan will be shared in due course.&#8221;<\/p>\n\n\n\n<p><a href=\"https:\/\/nationalpost.com\/opinion\/np-ivison-fisheries-minister-on-the-warpath-to-close-down-fishery\">Isaiah Robinson<\/a>, elected councillor and economic development head for the Kitasoo Xai\u2019xais First Nation in BC, said he\u2019s not confident the extra time will make any difference in Fisheries Minister Murray\u2019s approach.<\/p>\n\n\n\n<p>\u201cI\u2019ve interacted with her many times in the last two years since we\u2019ve had this situation, and knowing her and those discussions, her decision has already been made. . . She\u2019s on a warpath and she just wants to get this over with.\u201d<\/p>\n\n\n\n<p>The Kitasoo Xai&#8217;xais Nation at Klemtu on the central coast holds six of the 79 salmon farming licenses that could be in danger. Its smoked salmon is even sold in Walmart stores across Canada.<\/p>\n\n\n\n<p>Councillor Robinson says salmon farms in Kitasoo Xai\u2019xais territory account for $1.7 million in annual revenue, comprising more than half of an economy of $3 million.<\/p>\n\n\n\n<p>\u201cIf 51 per cent of our economy is gone, how are these people going to pay for new mortgages, for food, for all these other things we\u2019re hoping to do as a community? It\u2019s concerning for us all in trying to run a business in remote communities.\u201d<\/p>\n\n\n\n<p>At some point, Ottawa will also hear from the courts on the issue. Two First Nations, and the salmon farming industry, have taken the federal government to court \u2014 for the second time.<\/p>\n\n\n\n<p>The saga began in December 2020 when the then minister of fisheries and oceans, Bernadette Jordan,&nbsp;<a href=\"https:\/\/www.cbc.ca\/news\/canada\/british-columbia\/salmon-farms-discovery-islands-closing-1.5845502\">decreed<\/a>&nbsp;that open-net salmon farms in the Discovery Islands region near Campbell River BC must be phased out, and she would not renew their licences. She said she had consulted with seven First Nations, including the We Wai Kai and Wei Wai Kum.<\/p>\n\n\n\n<p>Salmon farm operators Mowi Canada West, Cermaq Canada and Grieg Seafood applied for a judicial review of then Minister Jordan\u2019s order that prevented them from restocking their farms. They argued the order lacked reasons and failed to show \u201can appreciation of the facts.&#8221; They also said they\u2019d be forced into losses and layoffs and would have to kill young fish that were currently being raised to go to the farms.<\/p>\n\n\n\n<p>In April last year, a federal court judge&nbsp;<a href=\"https:\/\/www.aquaculturenorthamerica.com\/federal-court-rejects-ministerial-bid-to-shut-down-b-c-salmon-farms\/\">set aside<\/a>&nbsp;Jordan\u2019s order. Justice Elizabeth Heneghan ruled that the minister had committed \u201ca breach of procedural fairness\u201d by announcing the closures via a news release.<\/p>\n\n\n\n<p>But then, Jordan\u2019s replacement as minister, Joyce Murray, challenging her department\u2019s scientists,&nbsp;<a href=\"https:\/\/www.nsnews.com\/highlights\/bcs-salmon-farm-transition-could-still-mean-ocean-based-farming-says-minister-5511739\">ruled in June 2022<\/a>&nbsp;that the farms would indeed be banned \u2014 as a \u201c<a href=\"https:\/\/www.cbc.ca\/news\/canada\/british-columbia\/fish-farm-closures-dfo-1.6788997\">precautionary measure<\/a>\u201d \u2014 although she would renew licences for two years.<\/p>\n\n\n\n<p>Now the elected councils of the Wei Wai Kum and We Wai Kai Nations have launched a second court challenge to Ottawa, following the decision of Minister Murray. So has salmon farm operator Mowi Canada West.<\/p>\n\n\n\n<p>Meanwhile, the Wei Wai Kum and We Wai Kai had been working with Cermaq Canada on new environmental rules and procedures for seven open-net farms in the Discovery Islands region in the two Nations\u2019 territory.<\/p>\n\n\n\n<p>Chris Roberts, elected chief councillor of Wei Wai Kum Nation, said: \u201cOf the seven sites we identified, we were going to start out with one. . . There was an agreement for a more&nbsp;<a href=\"https:\/\/www.vancouverislandfreedaily.com\/news\/fish-farm-decision-disregards-first-nations-input-wei-wai-kum-chief\/\">stringent threshold<\/a>&nbsp;for sea-lice levels. . . It was never a proposal that said, \u2018Please allow these seven sites to continue because we\u2019re comfortable with how that goes.\u2019\u201d<\/p>\n\n\n\n<p>The fisheries minister said no. The farms would stay closed.<\/p>\n\n\n\n<p>Chief Roberts said he\u2019s now worried that Ottawa will limit other types of development for his people. \u201cWe\u2019re interested in kelp; we\u2019re interested in other types of shellfish. There\u2019s tons of marine related activity. So is there going to be this high standard that our territory is going to be managed for some reason? It\u2019s never really been scientifically proven, why our territory is such a critical one for Fraser sockeye, but that\u2019s the excuse we\u2019re getting. That\u2019s really concerning for us.\u201d<\/p>\n\n\n\n<p>Chief Councillor Ronnie Chickite of the Wei Wai Kai says: \u201cThis court challenge is not about whether we support fish farming or not \u2013 it is about our inherent right as title holders to decide how our territory is used, and determine for ourselves if, when, and how fish farms could operate in the future.<\/p>\n\n\n\n<p>\u201cWe strongly believe the minister\u2019s decision to not reissue licences in our territories was a political decision heavily influenced by nations who do not have title in our territory.\u201d<\/p>\n\n\n\n<p>Later,&nbsp;<a href=\"https:\/\/www.campbellrivermirror.com\/news\/we-wai-kai-nation-members-we-dont-want-the-fish-farms-in-our-territory-says-petition\/\">a petition<\/a>&nbsp;signed by more than 100 of the We Wai Kai band\u2019s 1,200 members emerged, saying they \u201cdeclare our opposition to the actions of the elected leadership\u201d and&nbsp; \u201cdo not want the fish farms within our territory.\u201d<\/p>\n\n\n\n<p>First Nations are indeed divided on salmon farming. The&nbsp;<a href=\"https:\/\/www.campbellrivermirror.com\/news\/first-nations-wild-salmon-alliance-hit-ottawa-advocating-for-transitioning-fish-farms-out-of-b-c-waters\/\">BC First Nation Wild Salmon Alliance,<\/a>&nbsp;for example, calls for a switch to land-based aquaculture and accused the farms of contributing to the collapse of wild Fraser River salmon stocks. They said sea lice and other pathogens transfer&nbsp;from the farms to migrating juvenile wild salmon as they swim past the farms&nbsp;<em>en route<\/em>&nbsp;to the open ocean.<\/p>\n\n\n\n<p>Nonetheless, despite the alliance and the opinion of its minister, the DFO\u2019s own scientists&nbsp;determined the farms were of \u201cminimal risk\u201d&nbsp;to Fraser River salmon \u2014 based on nine separate peer-reviewed risk assessments.<\/p>\n\n\n\n<p>The debate on the science continues, with 16 Canadian fish scientists&nbsp;<a href=\"https:\/\/www.timescolonist.com\/local-news\/a-scientific-sin-16-canadian-salmon-scientists-claim-dfo-sea-lice-report-was-manipulated-6493604\">claiming<\/a>&nbsp;that the DFO\u2019s internal science report was manipulated and that its data was \u201ccherry-picked.\u201d<\/p>\n\n\n\n<p>More recently,&nbsp;<a href=\"https:\/\/seawestnews.com\/salmon-farms-have-no-impact-on-wild-stocks-states-new-study\/\">a new study<\/a>&nbsp;of Scottish salmon farms found they have nothing to do with declining wild salmon stocks. And author Dr. Martin Jaffa told BC\u2019s&nbsp;<em>SeaWest News<\/em>: \u201cIf the salmon farms and sea lice in European waters have no impact on wild stocks here, one can expect them to be the same in the Pacific Northwest.\u201d<\/p>\n\n\n\n<p>Meanwhile, the economic impacts are being felt by coastal communities.<\/p>\n\n\n\n<p>The BC Salmon Farmers Association called Murray\u2019s decision to terminate 19 ocean farms \u201cdevastating\u201d and protested: \u201cThe federal government continues to demonstrate a lack of care for rural coastal communities and continues to put the interests of activists above the people who grow Canada\u2019s food.\u201d<\/p>\n\n\n\n<p>The&nbsp;<a href=\"https:\/\/twitter.com\/FNFFSBC\">First Nations for Finfish Stewardship<\/a>&nbsp;(FNFFS) coalition likewise protested that federal decisions are resulting in the loss of investment, incomes and jobs \u2013 many of which are held by members of Indigenous communities.<\/p>\n\n\n\n<p>\u201cWe hope people ask, consider and respect whose territories those 57 remaining salmon farms are operating in,\u201d said the FNFFS. \u201cThose Nations have the right as title holders to decide how their territory is used, and determine if, when and how fish farms operate in their waters.\u201d<\/p>\n\n\n\n<p>The coalition asked: \u201cOttawa, do you see us? The social cost of closing salmon farms in our territories is a price no one should pay. Not our children, not our children&#8217;s children. Our rights, title, and self-determination matter, even 5,500 kilometres away from your city.\u201d<\/p>\n\n\n\n<p>In its court application, Mowi Canada West pointed out that before the decision to eliminate aquaculture in the Discovery Islands region, the company had 645 employees in BC, a significant number of whom were Indigenous. Now, that number has dwindled to 312.<\/p>\n\n\n\n<p>Brian Kingzett, executive director of the BC Salmon Farmers Association, fears that Ottawa will drive investment to places with lower regulatory standards and environmental monitoring.<\/p>\n\n\n\n<p>\u201cThose salmon will be grown elsewhere.
